As we age, many of us will face fiduciary elder abuse or financial scams. It's such an embarrassing event that few of us will come forward to family members or the authorities to report it. I know this firsthand because my husband and I experienced fiduciary abuse and we continue to walk in shame at our stupidity for trusting them, our attorneys, costing us over $2,200,000 in financial losses, not including the emotional distress they caused us. Our family does not know because we are so ashamed that we trusted them. But shouldn't we all be able to trust our attorneys?
In the picture, you see him, my husband, an elder, sharing a rare moment of peace with his daughter. That rooftop deck was always our dream—a symbol of the home he worked a lifetime to secure for retirement. But this rooftop deck is not ours; it’s part of a rental. We lost our dream retirement home with our cherished rooftop deck because of our bad-acting attorneys, the ones who were hired to protect it, worked against us and, never had the intention of going to trial. We allege they ultimately committed multiple unethical acts intended to harm our case during a settlement meeting, or mediation, costing us our home. We were badgered and lectured for over 12 hours until we finally "broke" and relented. To say a 12+ hour mediation is appropriate for elders would be an understatement.
Over the course of three long years in litigation, they exploited our trust, manipulated the legal system, and drained nearly half a million dollars in fees from us—money we worked decades to save for our retirement. They had one goal: to bilk us out of our cash before throwing us over the side of the boat. They even talked us into putting a second mortgage on our property as part of their scheme to drain us and, then, when the coffers were empty, they intentionally handed our assets to the other side during a settlement mediation. So, we are experts at such legal abuse of elders. It's an interesting business model we're calling the 'Bilk & Bury Scam' directed against seniors by their fiduciaries. It's unethical and we intend to work vigorously to change the ethical standards.
As a result of the shame my husband and I felt at our loss, we decided that rather than tell a victim story, we would work tirelessly to out bad acting fiduciaries and change the system that protects them over the protection of vulnerable seniors and the disabled.
No senior should ever be 'pig butchered' by a trusted fiduciary. Bad-actors need to be exposed for who and what they are: predators and scammers, and they need to lose their licenses or be banned from working with the elderly.
